1. Scope of Application
These Terms & Conditions apply to all orders placed by consumers (B2C) through the online shop AmiraPearls.
The seller is Swarnalekha Khandker, operating as a sole proprietor (Einzelunternehmen) under the name AmiraPearls.
The business operates under the small business regulation (§ 19 UStG). Therefore, VAT is not shown separately on invoices.
2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order.
By placing an order, the customer submits a binding offer. The contract is concluded when AmiraPearls confirms the order by email.
3. Prices and Payment
All prices are final prices in EUR.
Accepted payment methods:
- PayPal
- Klarna
- Bank Transfer
The seller reserves the right to refuse certain payment methods in individual cases.
4. Delivery and Shipping
Shipping areas:
- European Union
- United Kingdom
- Bangladesh
Shipping providers:
- DHL
- Hermes
- DPD
Delivery time: approximately 3–4 weeks for customized products unless otherwise stated.
If a product is unavailable, the customer will be informed immediately.
5. Right of Withdrawal
Consumers have a statutory right of withdrawal of 14 days.
The withdrawal period is 14 days from the day the customer receives the goods.
To exercise the right of withdrawal, the customer must inform AmiraPearls via email.
Consequences of withdrawal:
AmiraPearls bears the cost of return shipping.
Exclusion:
The right of withdrawal does not apply to customized or personalized products.
6. Retention of Title
The goods remain the property of AmiraPearls until full payment is received.
7. Warranty (Legal Guarantee)
The statutory warranty rights apply according to German law.
8. Liability
AmiraPearls is fully liable:
- for intent and gross negligence
- for injury to life, body, or health
For slight negligence, liability is limited to foreseeable damages typical for the contract.
9. Governing Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10. Online Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):

AmiraPearls is not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
